IdeaSphere Inc., owner of the Metabolife® brand (hereinafter referred to as “Metabolife”, “us” or “we”) respects the privacy of every individual who visits our websites, including but not limited to, metabolife.ca or metabolifecontest.ca (hereinafter referred to as “Site”) and we are strongly committed to protecting your personal information. Please take a moment to read the following Privacy Policy to understand how Metabolife collects, uses, discloses and safeguards the personal information you provide to us on or through the Site.
This Privacy Policy is incorporated into and forms part of the Terms of Use, which outlines the terms and conditions you agree to when accessing and using the Site. By accessing and using the Site, you agree and consent to the collection, use and disclosure of your personal information as outlined in this Privacy Policy and in accordance will all applicable Canadian privacy and data protection laws. For greater certainty, “personal information” means information about an identifiable individual, as defined in applicable Canadian privacy laws.
What Personal Information does Metabolife collect?
Sometimes Metabolife may ask you to provide specific personal information when you order a product online, enter a promotional contest or otherwise contact us. In such cases, Metabolife needs your personal information (including such information as your name, internet and/or e-mail address(es), billing address, shipping address, telephone number(s) and credit card number) in order to respond to your request or contact you. When obtaining personal information from you, Metabolife will ask only for the personal information we and/or our business partners need to provide the product and/or information you have requested or to enable us to administer a promotional contest.
What non-Personal Information does Metabolife collect?
Like many other commercial websites, the Site uses standard technology called a “cookie” that measures the number of visitors to the different sections of the Site. Cookies are designed, generally, to collect and store: (i) the name of the domain from which you access the Internet; (ii) the date and time you access the Site; and (iii) the Internet address of the website from which you linked directly to the Site. Metabolife uses the non-personal information collected by cookies to improve the Site and make it more useful to visitors. For greater certainty, our cookies do not collect personal information. If you wish to disable cookies, refer to your browser help menu to learn how to disable cookies. Please note that if you disable cookies, you may be unable to access some features on the Site. In addition, we sometimes we use web beacons and similar devices on the Site to enhance functionality and navigation for our visitors. Internet tags, graphic tags and similar web beacon type functions allow us to count the number of users who have visited a particular web page or to access certain cookies. We may use web beacons on the Site to count users and to recognize users by accessing our cookies. We may also include web beacons in HTML-formatted e-mail messages that we send to determine which e-mail messages were opened. Like cookies, web beacons do not collect or contain your name or your e-mail address.
How does Metabolife use and/or disclose personal and non-personal information?
Metabolife may use your personal and non-personal information to improve the Site, to provide a product or service to you, or to communicate with you about our products and/or services. When we send such communications, we also give you the option to opt-out of additional uses of your personal information for marketing purposes. For example, we may from time to time send you an e-mail message informing you of online sales that you may be interested in hearing about. If you do not wish to receive such messages from Metabolife, simply click on the “unsubscribe” button at the bottom of the email and follow the simple steps to opt-out of receiving such communications. We may also share your personal information with our business partners for: credit card processing and authentication, product delivery and/or other business purposes. However, Metabolife will only share your personal information with business partners upon terms that prohibit them from making any independent commercial use of your personal information and that prohibit them from sharing such personal information with third parties or otherwise making it publicly available.
Metabolife may disclose your personal information, without prior notice to you: (i) in response to law enforcement activity or other governmental requests; (ii) to respond to subpoenas, court orders or administrative agency requests for such information; (iii) to enforce our contract or property rights; (iv) to protect ourselves or others; or (v) when required or otherwise permitted by law. For example, we may share your personal information to reduce the risk of fraud or if someone uses or attempts to use the Site for illegal reasons or to commit fraud. Further, all personal and non-personal information we collect may be transferred: (i) in connection with any sale or merger of Metabolife or any division or business line of Metabolife to which such information relates; or (ii) if such information is included in a transaction for the sale or securitization of some or all of our assets.
How does Metabolife protect personal information?
Metabolife uses commercially reasonable means to protect the integrity of the Site and the confidentiality of all collected personal and non-personal information. Thus, if you place an order with us, we will use Secure Sockets Layer encryption to protect the security of the transaction. Unfortunately, however, no database or data transmission over the internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction or inadvertent disclosure of your personal information. Consequently, Metabolife, its affiliates and any directors, officers, employees, agents, contractors or subcontractors of the foregoing do not represent, warrant or guarantee that your personal information will be protected against misuse, loss or modification, nor do such parties accept liability for the security of any personal information you submit on or in connection with the Site.
Some or all of the personal information we collect may be stored or processed on computers located outside your jurisdiction of residence, whose data protection laws may differ from the jurisdiction in which you live. As a result, this information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions. Subject to applicable laws in such other jurisdictions, we will ensure that appropriate protections are in place to require the data processor in that country to maintain protections on the personal information that are equivalent to those that apply in the country in which you live.
Collection of personal information from minors
The Site is intended for use only by individuals who are of the age of majority in their jurisdiction of residence. If you are not of the age of majority in your jurisdiction of residence, then do not submit any personal information to the Site. If a minor has already provided us with personal information, then his or her parent/legal guardian may contact us for the purpose of deleting this information.

The Site may contain links to websites of retailers or other third parties who are not affiliated with Metabolife. We are not responsible for the operation of, or collection of, any information from, any websites operated by unaffiliated third parties. Changes to this privacy policy
Our business and the laws that regulate us change from time to time, and we reserve the right to change this Privacy Policy, in our sole discretion, at any time. If we do change this Privacy Policy, we will post the revised version on this Site. Please check back from time to time to ensure that you are aware of any updates or changes in this Privacy Policy. If you do not agree to (or cannot comply with) the Privacy Policy, as amended, your only remedy is to stop using the Site. You will be deemed to have accepted the Privacy Policy as amended, if you continue to use the Site after any amendments are posted.
